Terms & Conditions
Payment & Reservation of Date
The total order balance is due upon booking unless otherwise agreed to in writing by the Business. An order is not considered confirmed and no event date will be reserved until payment has been received and cleared.
Payment is accepted only through Square invoicing or cash paid directly to the Business. Personal checks, third-party payment arrangements, and payment plans are not accepted unless expressly approved in writing.
Invoices must be paid within twenty-four (24) hours of issuance. Failure to remit payment within this timeframe may result in cancellation of the invoice, release of the reserved event date, and forfeiture of the quoted pricing. The Business reserves the right to revise pricing, availability, and production scheduling for any unpaid order.
Because custom cakes and desserts require advance planning, design work, scheduling, and procurement of supplies, all payments are subject to the cancellation terms outlined below.
Deposits, Cancellations & Rescheduling
Upon booking, fifty percent (50%) of the total order amount shall be considered a non-refundable retainer. The retainer compensates the Business for reserving the event date, declining other potential orders, allocating production capacity, conducting consultations, creating design concepts, communicating with vendors, and purchasing materials.
If the Client cancels more than thirty (30) calendar days before the scheduled pickup or delivery date, any payments made beyond the non-refundable retainer may be refunded at the Business's discretion, less any expenses already incurred.
If the Client cancels within thirty (30) calendar days of the scheduled pickup or delivery date, no refunds shall be issued. At this stage, the Business may already have purchased materials, begun preparation, scheduled labor, or otherwise committed resources specifically for the order.
Requests to reschedule are not guaranteed. The Business may approve a transfer to a new date based solely on availability. Any approved transfer may be subject to updated pricing and additional fees.
All cancellations and rescheduling requests must be submitted in writing.
Cake Design, Artistic Interpretation & Inspiration Photos
The Client acknowledges that all custom cakes and desserts are artistic creations. While the Business will make reasonable efforts to incorporate requested themes, colors, design elements, and inspiration photos, the final product will reflect the Business's unique artistic style and professional judgment.
No cake or dessert will be an exact replica of another artist's work, a previous creation, a social media image, Pinterest image, stock photograph, or inspiration photo. Minor variations in color, texture, placement, proportions, decorative elements, and finishing details are expected and shall not constitute a defect.
Color matching cannot be guaranteed. Actual colors may appear different due to lighting conditions, edible coloring limitations, printing variations, monitor displays, photography settings, and ingredient interactions.
The Client understands that budget limitations may affect the level of detail and complexity that can reasonably be achieved.
AI-Generated Images & Unrealistic Designs
The Business does not guarantee replication of any AI-generated image.
AI-generated cake concepts frequently depict decorations, structural elements, proportions, materials, colors, or techniques that are not physically possible, food-safe, stable, transportable, or commercially reasonable.
Any AI-generated image supplied by the Client shall be treated solely as inspiration. The Business reserves the right to modify, simplify, substitute, or eliminate design elements that would compromise food safety, structural integrity, transportation, production timelines, or artistic quality.
The final product may differ substantially from an AI-generated reference image. Such differences shall not constitute grounds for cancellation, refund, replacement, or dispute.
Allergies & Dietary Restrictions
The Business works with ingredients including, but not limited to, wheat, milk, eggs, soy, peanuts, tree nuts, coconut, and other common allergens.
While reasonable efforts may be made to accommodate dietary preferences and allergen concerns, the Business cannot guarantee that any product is completely free of cross-contact or cross-contamination.
Clients with severe allergies acknowledge and accept the inherent risks associated with consuming products prepared in a shared kitchen environment.
It is the Client's responsibility to communicate all allergy concerns prior to booking.
Rush Orders
Orders requested within fourteen (14) calendar days of the pickup or delivery date may be considered rush orders.
Acceptance of any rush order is entirely at the discretion of the Business and depends upon scheduling availability, ingredient availability, staffing capacity, and overall production demands.
Approved rush orders may incur an additional fee. Rush fees are non-negotiable and compensate the Business for expedited scheduling, supply acquisition, labor adjustments, and production prioritization.
Rush fees are non-refundable.
Pickup Policy
If no specific pickup time has been arranged, the standard pickup window shall be between 12:00 PM and close of business, Wednesday through Saturday.
The Client is responsible for arriving during the agreed pickup window.
Once the product leaves the Business's possession, the Client assumes all responsibility for transportation, handling, storage, setup, and care of the product.
The Business will provide transportation and handling recommendations upon request. Failure to follow those recommendations may result in shifting, cracking, melting, breakage, or other damage for which the Business is not responsible.
If a Client fails to pick up an order during the agreed timeframe and does not communicate with the Business, the Business is not responsible for any deterioration in quality or appearance caused by delays.
Delivery Policy
Delivery is available for an additional fee of $0.75 per mile round trip. Mileage shall be calculated using Apple Maps from the Business location to the delivery destination.
Delivery times are estimated and not guaranteed. The Business shall not be liable for delays caused by traffic, weather conditions, road closures, accidents, venue restrictions, acts of God, or other circumstances beyond its reasonable control.
Three-tier and larger cakes require delivery by the Business due to the increased risk of structural damage during transportation.
Upon delivery and acceptance by the Client, venue representative, designated recipient, or event coordinator, responsibility for the product immediately transfers to the receiving party.
Product Storage & Care
Cakes and desserts are perishable food products.
The Client is responsible for maintaining proper storage conditions once the product has been delivered or picked up.
Products should be stored according to the care instructions provided by the Business. The Business shall not be liable for damage or deterioration resulting from exposure to heat, sunlight, humidity, refrigeration issues, transportation conditions, venue conditions, or improper handling.
Risk of Loss
The Business retains responsibility for the product only until the product has been successfully delivered or released to the Client through pickup.
Once possession transfers to the Client or the Client's representative, all risk of loss transfers to the Client.
The Business shall not be responsible for any damage, collapse, melting, shifting, breakage, theft, contamination, mishandling, or deterioration occurring after transfer of possession.
Receipt and acceptance of the product constitute acknowledgment that the order was received in satisfactory condition.
No Refund Policy
Due to the custom, perishable, and time-sensitive nature of baked goods, all sales are final.
No refunds will be issued after pickup, delivery, or acceptance of any product.
If the Client believes a product was not prepared according to the agreed written specifications, the Client must submit a written complaint within twenty-four (24) hours of pickup or delivery and provide clear photographs of the alleged issue.
The Business reserves the right to inspect the product and may require return of any remaining portion for evaluation.
Taste, texture, color variations, artistic interpretation, and personal preferences are subjective and shall not constitute grounds for refunds.
If the Business determines that an error occurred, the Business may, at its sole discretion, offer one of the following:
Replacement product
Partial replacement product
Store credit
Future order credit
The Business is under no obligation to issue a monetary refund. This policy is disclosed to the Client before purchase. [fairfaxcounty.gov]
Limitation of Liability
In no event shall the Business be liable for indirect, incidental, special, consequential, emotional, or punitive damages arising from the order, including event disruption, disappointment, loss of enjoyment, venue costs, photography costs, travel costs, or other related expenses.
The maximum liability of the Business shall not exceed the amount actually paid by the Client for the affected product.
Agreement
By placing an order, paying an invoice, signing electronically, providing initials, or otherwise proceeding with a purchase, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions in their entirety.
